AGREEMENT TO OUR LEGAL TERMS

We are EZ Test Prep, LLC, doing business as EZ Prep (“Company,” “we,” “us,” or “our”), a company registered in Colorado, United States, Denver, CO 80200.

We operate the website https://www.eztestprep.com/ (the “Site”), multiple mobile applications published under the EZ Prep brand on the Apple App Store and Google Play Store (the “Apps”), as well as any related products, services, or digital content that link to these legal terms (the “Services”).

These Legal Terms constitute a legally binding agreement between you (“you”) and EZ Test Prep, LLC regarding your access to and use of the Services. By using the Services, you agree to be bound by these Legal Terms. If you do not agree, you must immediately discontinue use.

We reserve the right to update these Legal Terms at any time. Updates will be reflected by the “Last Updated” date, and continued use of the Services constitutes your acceptance of any changes.

IMPORTANT EDUCATIONAL DISCLAIMER

EZ Prep provides test preparation study aids only. Our Apps are designed for educational purposes to help users practice and prepare for standardized exams.

  • They are not substitutes for accredited education, professional training, licensure programs, clinical instruction, or supervised practice.

  • No medical, counseling, legal, or professional advice is provided. Do not rely on our content for real-world professional decision-making, treatment, or safety-critical applications.

  • We are not affiliated with, endorsed by, or sponsored by any official exam boards or organizations (including but not limited to NBCE, NBSTSA, ASWB, NCE, NPTE, PTCB, ServSafe, HESI, or any state or national licensing authority). All trademarks and exam names belong to their respective owners.

  • Use of the Services does not guarantee exam success unless explicitly stated under our Pass Guarantee Policy.

The Services are intended for users 18 years or older. If you are under 18, you may only use the Services with parental or guardian consent.

We recommend that you print a copy of these Legal Terms for your records.

1. Our Services

The Services consist of EZ Prep mobile applications and related study materials made available on the Apple App Store and Google Play Store. They provide practice questions, study tools, and educational aids for exam preparation.

The Services are not tailored to comply with industry-specific regulations (including HIPAA, FISMA, GLBA, etc.). If your use of the Services would be subject to such laws, you may not use the Services.

2. Intellectual Property Rights

We are the owner or licensee of all intellectual property rights in our Services, including source code, databases, functionality, design, audio, video, text, images, study materials, and graphics (collectively, the “Content”), as well as all trademarks, logos, and branding (the “Marks”).

The Content and Marks are protected under copyright and trademark law. You may only use them for your personal, non-commercial purposes in connection with studying through the Services.

Unauthorized copying, distribution, or commercial exploitation is prohibited.

3. User Representations

By using the Services, you represent and warrant that:

  1. You have legal capacity and agree to comply with these Terms.

  2. You are not a minor (or have parental/guardian consent if under 18).

  3. You will not use bots, scripts, or automated methods to access the Services.

  4. You will not use the Services for unlawful purposes.

  5. Your use complies with applicable laws and regulations.

4. Products

All products and content within the Services are subject to availability. We may modify or discontinue any portion of the Services at any time.

5. Purchases and Payment

All purchases and payments are processed by Apple App Store or Google Play Store.

  • You must provide current and accurate payment information.

  • Prices are subject to change.

  • Taxes may be applied where required.

  • We may refuse or cancel orders at our discretion.

6. Subscriptions

Billing and Renewal

  • Subscriptions renew automatically until canceled.

  • Billing cycles may be weekly, monthly, or multi-month.

  • You authorize the App Distributor (Apple or Google) to charge your payment method.

Cancellations

  • You must cancel your subscription directly through your Apple ID or Google Play account.

  • Cancellation takes effect at the end of the current billing period.

Refunds

Pass Guarantee

EZ Prep may, at its discretion, offer a Pass Guarantee on select apps. This guarantee allows qualifying users who fail their official exam to request a refund and an additional six (6) month subscription at no cost.

To qualify, all of the following requirements must be met:

  1. Active Subscription: You must have an active, paid subscription purchased through the Apple App Store or Google Play Store.

  2. Minimum Subscription Period: You must have maintained a paid subscription for at least two (2) consecutive months prior to your exam date.

  3. Study Activity: You must have completed at least five hundred (500) unique practice questions in the app prior to your exam.

  4. Performance Threshold: You must have achieved at least an eighty percent (80%) cumulative average score across attempted questions.

  5. Proof of Use: You must provide screenshots with visible timestamps verifying your question attempts and performance.

  6. Proof of Exam Results: You must provide an official copy of your failed exam score report.

  7. Timely Request: You must submit your request within thirty (30) days of the failed exam attempt.

Request Process:

  • Email support@eztestprep.com with the subject line “Pass Guarantee Request.”

  • Include all required proof documents (screenshots, exam report, subscription details).

Limitations:

  • The Pass Guarantee applies only to the initial purchase and consecutive subscription renewals directly tied to the qualifying app.

  • Refunds will only be issued once per user per exam type.

  • Group subscriptions, shared accounts, or family accounts are not eligible.

  • We reserve the right to update, modify, or discontinue the Pass Guarantee at any time without prior notice.

7. Refunds Policy

Please review the applicable App Distributor’s refund policy before purchase. We do not issue refunds directly.

8. Prohibited Activities

You agree not to misuse the Services. Prohibited activities include but are not limited to:

  • Copying or distributing content.

  • Attempting to bypass security features.

  • Using the Services for harassment or unlawful purposes.

  • Reverse-engineering or modifying the Apps.

  • Using automated bots, scrapers, or similar tools.

  • Impersonating other users.

  • Commercializing or reselling the Services.

9. User Generated Contributions

You may have opportunities to provide content (e.g., feedback, comments). You are solely responsible for your Contributions and must not post unlawful, harmful, or infringing material.

10. Contribution License

By submitting Contributions, you grant EZ Prep a non-exclusive, worldwide license to use them for any lawful purpose, including improvement of Services.

11. Guidelines for Reviews

Reviews must reflect genuine experiences and must not be defamatory, false, or misleading. We may remove reviews at our discretion.

12. Mobile Application License

You are granted a limited, revocable, non-transferable license to install and use the Apps on your personal device(s).

Apple & Google Play Terms

  • Apps are licensed, not sold.

  • Support obligations rest with EZ Prep, not Apple or Google.

  • Both Apple and Google are considered third-party beneficiaries of these Terms.

13. Services Management

We may monitor, suspend, or terminate access at our discretion for violations of these Terms.

14. Privacy Policy

Your use of the Services is governed by our Privacy Policy: https://www.eztestprep.com/privacy-policy.

15. Term and Termination

We may terminate or suspend your access at any time for violations of these Terms.

16. Modifications and Interruptions

We may change, update, or discontinue any part of the Services at any time without liability. Availability is not guaranteed.

17. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.

18. Dispute Resolution

  • Informal Negotiations: Required before arbitration.

  • Binding Arbitration: Conducted under AAA Consumer Rules, in Denver, Colorado.

  • Class Actions Waived: Disputes must be resolved individually.

  • Exceptions: IP disputes, theft, and injunctive relief may proceed in court.

19. Corrections

We reserve the right to correct any errors or inaccuracies within the Services.

20. Disclaimer

The Services are provided “as is” without warranties of any kind.

  • We do not warrant accuracy or completeness of content.

  • We disclaim responsibility for errors, downtime, or third-party issues

  • Exam success is not guaranteed.

21. Limitations of Liability

To the fullest extent permitted by law, our liability is limited to the amount you paid us in the six (6) months preceding any claim.

22. Indemnification

You agree to indemnify and hold us harmless from claims arising from your misuse of the Services or violation of these Terms.

23. User Data

We may maintain certain user data. You are responsible for backing up your own data.

24. Electronic Communications, Transactions, and Signatures

You consent to electronic communications and signatures in connection with the Services.

25. California Users and Residents

Unresolved complaints may be directed to the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834; (800) 952-5210.

26. Miscellaneous

These Terms are the entire agreement between you and us. If any provision is deemed invalid, the remainder still applies.
